A.G. Gaston, Saber construction companies dismissed from Bresette lawsuit with prejudice

BIRMINGHAM, Ala. -- Two construction companies listed as defendants in the lawsuit over the flight information display accident that claimed the life of a Kansas boy at Birmingham-Shuttlesworth International Airport last year have been dismissed with prejudice, according to a court order obtained by ABC 33/40.

A.G. Gaston Construction Company, Inc. and Saber Construction, Inc. were dismissed from the civil action case filed in June 2013 by the Bresette family, who are seeking monetary damages from several companies for the death of their 10-year-old son, Luke.

The order, which forbids the plaintiffs from re-filing the case against A.G. Gaston and Saber, was filed Wednesday in Jefferson County Circuit Court and signed by Judge Tom King Jr..

Companies still listed as defendants in the lawsuit include Brasfield & Gorrie General Contractors, Inc., BLOC Global Services Group, LLC., KPS Group, Inc. and KHAFRA Engineering Consultants, Inc.

The Bresette's are being represented by attorneys Tim E. Dollar and Tim Becker with the Kansas City-based firm Dollar, Burns & Becker.
