Housing authority files response to gas explosion wrongful death complaint

The legal fight over Marks Village apartments continues to take shape. The housing authority claims no responsibility after a gas explosion killed one woman and injured others.

Following the December fatal explosion at Marks Village, investigators released facts- a gas leak caused the explosion that killed Tyrennis Mabry and injured others.

Mabry's family is suing Alagasco and the Housing Authority of the Birmingham District.

But now in a recent filing, the housing authority stipulates no knowledge or information sufficient about those same details. It also stipulates no knowledge or information sufficient about numerous complaints about gas leaks and odors or a breach of duty on its part.

Even though the filing says Alagasco admitted owning and operating pipeline that was installed in 1951 and that defendants had been put on notice about its "abnormally high risk of harm to people," the housing authority claims no knowledge or information sufficient.

The housing authority is a government entity. As the filing points out, that makes it immune under Alabama Code from prosecution. However, another state law does allow for up to 300 thousand dollars of damages when two or more people are injured.
