Judge declares mistrial in infant death case

A judge in Decatur has declared a mistrial in the capital murder case of a man accused of killing his 4-month-old daughter. 41-year-old Gary Lee Wilbourn of Lacey's Spring is accused of shaking his infant daughter to death in December of 2008.
Before the testimony even started on Friday, Morgan County Circuit Judge Steven Haddock postponed the trial.
The jury selection, which began Monday, was interrupted by the winter storm.  The mistrial resulted from prosecutors and defense attorneys having scheduling problems with expert witnesses.
The judge rescheduled the trial for April 19.
