Private School Tax Credits

Posted: Updated:

A Montgomery Circuit Court Judge heard arguments Thursday on the Alabama Education Association's lawsuit on the Alabama Accountability Act.
Even though it will be a few weeks before Judge Gene Reese has to make a decision on the challenge to the law that allows tax credits for private education, the attorney have a couple of weeks to submit proposed orders in the case.
Judge Reese it expected to rule sometime after those proposals are turned in.
The attorney for the AEA, Bobby Segall, has argued that the Accountability Act has two subjects in the bill even though Alabama's Constitution only allows one.  Segall says one subject gives public schools flexibility to comply with state regulations, and the other provides tax credits to parents transferring children from failing public schools to private schools.
Assistant Attorney General Will Parker counters that argument, affirming the bill has just one subject, and that's education.
