Police shoot man in parking lot; Attorney’s Office says not enough evidence to prosecute

The U.S. Attorney's Office in Georgia has determined there is not enough evidence to warrant prosecution for civil rights violations after a man was shot and killed by a police officer.

Sammie Davis Jr., was shot to death in a Kroger parking lot in Macon, Ga. on Dec. 21, 2012 because authorities say the policeman feared for his life. District Attorney David Cooke's conclusion that Macon officer Clayton Sutton was justified in shooting Davis sparked protests and requests for federal intervention.

Officer Sutton was treated for injuries suffered after Davis lunged at him outside the store.

U.S. Attorney Michael Moore said the Justice Department and his office, "determined that the evidence in this case is insufficient to meet the rigorous requirements of a federal criminal civil rights prosecution."
