Hundreds attend third cemetery bankruptcy meeting

Posted: Updated:

Hundreds packed an auditorium Tuesday night to hear the next step on legal action to help those affected by the closure of "George-Washington-Carver Memorial Gardens Cemetery."

A bankruptcy creditor hearing is this Friday. The meeting helped prepare people for resolution of the situation.

People could get help filling out creditor proof of claim forms, making sure it's done correctly. State Representative Jaundalynn Givan says a trustee is now in place to possibly find someone to buy the property. She says Governor Robert Bentley is also trying to get the State Attorney Generals Office involved.

This is the third meeting now reaching out to folks like Jerome Weldon, unsure about the future of the site where he wants to be buried. "My mother's buried at George Washington Carver and graves we've purchased are right around her "

The owner of "George Washington Carver Memorial Gardens" filed bankruptcy and people are now preparing to file claims against the cemetery.

Rosie Jordan says "I never thought that cemetery wouldn't be available."

Rosie Jordan and Naomi Baldwin both have family buried in the cemetery.

Baldwin says, "So many people have sacrificed their time, their money and then be treated like this, it's not fair."

For that reason.. many showed up to hear how to complete a bankruptcy claim form. Weldon says, "I did look over the paperwork. there are some things I understand, some I don't."

Along with explaining paperwork, State Representative Juandalynn Givan let people know Governor Robert Bentley is looking at getting the state involved and whether corporate private contributions could be put into an oversight committee fund for the cemetery.

A trustee also has been named and Givan says, "The trustee can say, I'm going to find someone to buy this property, he has that power and what makes that recommendation of course, ultimately the judge will sign off on it."

Givan asked people to be at a creditor hearing Friday to push the urgency of the matter.

Baldwin says, "We're hoping that we can get some answers and that somebody will come by and take over."

The hearing is set for 10:00 Friday morning in the Robert S. Vance Federal building. Givan says February 3rd is the deadline to have the creditors claim form in. A cemetery clean-up day is also scheduled for this Saturday.
