2 Birmingham men charged with murder for shooting death of landscaper (Update)

A 24-year-old Birmingham man has been charged with capital murder for the shooting death of a 76-year-old landscaper.

Donovan Burke has been arrested and is currently awaiting transfer to the Jefferson County Jail after he allegedly shot and killed Birl Jackson Monday morning. Jackson, the owner of Jackson Lawn Service and a youth minister, was found shot inside his truck shortly before 9 a.m. in the parking lot of Zion Star Missionary Baptist Church where some of his employees were cutting grass.

"He was gagging. We were telling him to stay in there, hang in there. You will be alright. You will live. It eventually got quiet." neighbor Gregory Muhammad told ABC 33/40 Monday.

Birmingham police officers believe the shooting occurred during a robbery attempt shortly after Jackson arrived at the church to make a drop-off to his workers. He was pronounced dead at UAB Hospital at 9 a.m.

Friends of Jackson said the victim was a good person, widely known for volunteering in the community and for his service as a deacon at Calvary Baptist Church.

"There would be no reason anyone would think to do anything like that to him. He didn't deserve anything like that. He was too good of a person," said Eunice Parler, a longtime friend of Jackson.

Sgt. Johnny Williams of the Birmingham Police Department announced the arrest of a second suspect in the shooting Tuesday night. Adrian Dunning, 28, of Birmingham, has been charged with murder in connection to the shooting death of Jackson. Dunning had previously been held for questioning in the case before being released after posting bond for an unrelated outstanding warrant. He was re-arrested and is currently being held in the Jefferson County Jail without bond.
