Birmingham man charged with capital murder in death of 4-year-old boy

The Birmingham Police Department reports that detectives have arrested and charged a suspect in connection with a homicide investigation. The investigation began on Sunday, December 16, 2012, at approximately 8:30 p.m., when officers responded to Children's Hospital Emergency room to investigate a recently deceased person. Officers found that Birmingham Fire and Rescue had recently transported the victim prior to his death. Hospital staff alerted officers of bruising on various parts of the victim's body.

Upon completion of the medical examination, the Coroner's office determined that the victim's manner of death is homicide as a result of his injuries. During the course of the investigation, detectives discovered that the boyfriend of the victim's mother was the person responsible for the injuries on the victim.  

The victim has been identified as Jamarion Swinnie, 4, of Birmingham.

The suspect has been identified as Robert Lewis Martin, 25, of Birmingham. A Capital Murder warrant has been obtained against the suspect. The suspect is in the custody of the Jefferson County Jail.
