Macy's sued the media and merchandising company Stewart founded for breaching an exclusive contract when she signed a deal with JC Penney to open shops at most of its stores this spring.
Macy's is trying to block JC Penney from selling the same products it's been selling since 2007.
Florida Sinkhole
Another sinkhole is being monitored in Florida, just three miles from the deadly one that swallowed a man sleeping in his bed last week.
The earth opened up between two homes in Hillsborough County.
There's no reported damage, but a fence dividing the properties is broken. No evacuations have been ordered.
Experts say the two sinkholes are not geologically connected.

Justin Bieber is catching flack from fans in the UK. He was scheduled to go on stage at London's O2 arena at 8:30 last night.
But, due to what's being called "some technical difficulties" he didn't begin singing until about two hours later.
Fans who actually stuck around for the concert were given no explanation for the absence while they waited.
Bieber apologized to fans on Twitter this morning.
Police Dog Fires Gun
A Massachusetts family is thankful one police K-9 is a "bad shot."
Ivan was searching for a gun, hidden by a suspect in a snowbank Sunday. When he finally got his paws on the weapon, he somehow pulled the trigger, firing the weapon.
The bullet went into a nearby house where three people were sleeping.
No one was injured.
