The Alabama Education Association filed a lawsuit Tuesday to try to block Gov. Robert Bentley from signing legislation providing tax credits to parents who move their children from failing public schools to non-failing public schools or private schools.

The governor is planning to sign the legislation Tuesday afternoon.

The AEA's suit argues that the Legislature violated the open meetings act and other laws when it passed the legislation with a quick series of votes last Thursday night.

The case has been assigned to Montgomery Circuit Judge Charles Price.

State School Superintendent Dr. Tommy Bice and others, on Monday, urged the governor to make changes in the bill and send it back to the Legislature.

ABC 33/40's Honora Gathings is working on the story.  She will have complete reports on Focus@4, as well as the News at 5 and 6.
