Teen accused of attack plan waives hearing

An Alabama teenager accused of plotting to attack classmates with a small homemade explosive device has waived his right to a preliminary hearing. Now his case will go to a grand jury for possible indictment.

The attorney for 17-year-old Derek Shrout told Russell County District Judge David Johnson in court Tuesday his client would waive the hearing. Chief Deputy District Attorney Buster Landreau said the next meeting of the grand jury is May 6. Shrout's attorney, Jeremy Armstrong, declined to comment about the case or say why the right to the hearing was waived. Shrout is free on $75,000 bond on an attempted assault charge and was not in court.

Authorities say he planned to use homemade explosives to attack fellow students at Russell County High School in eastern Alabama.
