Lawsuit against City of Pelham settled

A lawsuit filed against the City of Pelham by city employees has been resolved and dismissed.

The 34-page lawsuit was filed January of last year and claimed former Pelham Mayor Don Murphy violated personnel policy when he went over the personnel board to create a marketing director job for a campaign supporter one month after his 2008 election.

Pelham Mayor Don Murphy, Finance Director and City Clerk Tom Seale, Human Resources Director Jerry Nolen, and Marketing Director Eva Shepherd were all named as defendants. Plaintiffs included Jim Collins and James Burks, both members of the Pelham Personnel Board, and five city employees.

According to the lawsuit, Murphy continued to violate board policies by benefiting friends instead of complying with the Pelham Personnel Board's merit system. It also stated two employees were fired without cause, changing job responsibilities, and freezing merit and cost of living raises for only workers of the Pelham Civic Complex, which is newly named the Pelham Civic Complex and Ice Arena.

The employees listed as plaintiffs asked for their jobs back and to be compensated for lost pay.

The suit was settled on Friday by all parties involved.
