Driver responsible for fatal accident in Tuscaloosa has charges upgraded

    The Etowah County Sheriff's Office says an inmate kitchen worker escaped the Etowah County Detention Center Friday morning. 

Rusty Allen, 32, had his misdemeanor charges upgraded to felonies for his involvement in a November accident in Tuscaloosa that left 48-year-old Anthony Naylor dead and two other passengers severely injured.

Allen is charged with one count of felony murder, and had his original three charges of third-degree assault upgraded to felony first-degree assault. Prosecutors felt the severity of the injuries to the other passengers warranted the upgraded charges.

Naylor died at DCH Regional Hospital on November 16 from injuries he sustained in the accident. His wife suffered spinal fractures in the wreck and his 16-month-old child had to be airlifted to Children's of Alabama.
