Online court records show Harvey Updyke's trial is set to resume October 1, 2012.
He is charged with poisoning the iconic live oaks at Auburn's Toomer's Corner. Updyke's trial was delayed last month after lawyers argued the jury pool had been tainted. You'll remember, Updyke reportedly told a student newspaper reporter that he had poisoned the trees.
Updyke's attorney wants a change of venue. A hearing date for that has yet to be set.
