An attorney for former Governor Don Siegelman is asking a judge to set aside an order denying his client a new trial.
Attorney Peter Sissman filed the request Monday in Montgomery. He wants the order delayed so he can have more time to collect documents on U.S. Attorney Leura Canary. She was the chief federal prosecutor in Montgomery during the case, but she later stepped aside.
Siegelman's defense team says she still had some involvement in the case.
The move comes after a judge denied Seigelman's request for a new trial last week.
