Young's attorneys want more time to appeal judge's initial decision

Attorneys for Jefferson County sewer receiver John Young filed a motion in court Wednesday requesting clarification on two arguments struck down last week or an extension to file an appeal.

Last week, federal bankruptcy Judge Thomas Bennett rejected two legal arguments Young cited in his attempt to keep control of the sewer system.

Bennett rejected the arguments that federal courts are not allowed to interfere with state court action. He also struck down points related to an act that prevents federal courts from taking part in the rate setting of state utilities.

Young's attorneys want to know if that decision was final or temporary. If it's final, they are requesting more time to appeal it.

Right now, the deadline for appeals is December 12.

Young and Jefferson County are still awaiting a decision from Bennett about whether Young will stay or go during bankruptcy proceedings.
