26 year old Nicholas Keith Smith is charged with rape and possession of obscene material.

Police say Smith who teaches history and coaches baseball at Gadsden City High School had a sexual relationship with a 15 year old student. They say the incidents took place off campus and after hours. Police also say they found pornographic materials depicting a minor.

Parents didn't want to go on camera but told ABC 33/40 that they just heard the news and were concerned.



But some students say they were surprised.

Etowah County District Attorney Jimmie Harp released a statement saying, " the preliminary investigation seems to indicate that this was an isolated incident between Smith and the student. However, this investigation is not over."

Harp also said, "safety of the students at the school has been a paramount issue for the school, and I am confident that they have proper safety measures in place."

ABC 33/40 was unable to reach anyone at Gadsden City schools.

A message was left for the principal about Smith's employment status with the school.

If he is convicted, he could face 20 years in prison.
